These Terms and Conditions ("Agreement") govern the use of the services provided by [The Native NYC Tour, LLC] ("Company") to its clients ("Clients" or "You"). By booking a tour or using any of the services provided by the Company, you agree to be bound by these Terms and Conditions.

1.1 Booking Confirmation: To secure a tour, Clients must make a reservation through the Company's designated channels. The Company will confirm the booking via email or any other agreed-upon method.

1.2 Payment: Clients are required to pay the agreed-upon tour fees in full at the time of booking, unless otherwise specified. Payment methods accepted by the Company may include credit cards, bank transfers, or any other methods specified by the Company.

1.3 Pricing: The prices quoted by the Company are in the currency stated and are inclusive of all applicable taxes, unless otherwise specified. The Company reserves the right to modify prices at any time, but the changes will not affect already confirmed bookings.

2.1 Cancellation by the Client: If you need to cancel your tour, you must notify the Company in writing. The cancellation will be effective from the date the Company receives the written notice. Cancellation fees may apply, and they are outlined in the Company's cancellation policy, which will be provided to you at the time of booking.

2.2 Cancellation by the Company: The Company reserves the right to cancel or modify a tour due to unforeseen circumstances, including but not limited to weather conditions, natural disasters, civil unrest, or insufficient bookings. In such cases, the Company will provide alternative options or offer a full refund of the tour fees paid.

2.3 No Shows: Failure to arrive at the designated meeting point or failure to join the tour at the scheduled time without prior notice will be considered a "No Show." No refunds will be provided for No Shows.

2.4 Refunds: Refunds, if applicable, will be processed using the same method used for the initial payment. The Company will not be responsible for any fees or exchange rate differences incurred during the refund process.

3.1 Health and Fitness: Clients must ensure they are in good health and have the physical fitness necessary to participate in the chosen tour. Some tours may involve physical activities or require a certain level of fitness. It is the Clients' responsibility to assess their suitability for the chosen tour.

3.2 Conduct: Clients are expected to behave in a respectful and responsible manner throughout the tour. The Company reserves the right to refuse service or remove Clients from a tour if their behavior is deemed offensive, disruptive, or endangers the safety of other participants.

3.3 Compliance with Laws: Clients must comply with all applicable laws and regulations of the destination country during the tour. The Company will not be liable for any consequences resulting from the violation of such laws.

4.1 Assumption of Risks: Participating in tours provided by the Company may involve inherent risks. Clients acknowledge and accept these risks and agree that the Company will not be held liable for any loss, injury, damage, delay, or expense incurred during the tour, unless caused by the Company's negligence or willful misconduct.

4.2 Travel Insurance: Clients are strongly advised to obtain comprehensive travel insurance to cover any potential risks, including but not limited to trip cancellation, medical expenses, baggage loss, or personal liability.

5.1 Copyright: All materials provided by the Company, including but not limited to brochures, itineraries, photographs, and website content, are protected by copyright laws. Clients may not reproduce, modify, distribute, or use
